According to a senior official at the Equal Employment Opportunity Commission (EEOC) who spoke to NT Lakis attorneys this week, the agency will delay the beginning of the EEO-1 filing season as a result of the ongoing partial government shutdown, which includes the EEOC. The official also confirmed that the EEO-1 online filing system will also remain closed during the shutdown, and employers that may need to access the system to respond to information requests from other government agencies will not be able to do so.
Under the normal filing schedule, covered employers are required to file their 2018 EEO-1 reports by March 31, 2019, using a data snapshot generated during the fourth quarter of 2018. The EEOC official indicated that the agency will determine whether to extend the EEO-1 filing deadline, and the length of any such extension, if it is granted, at a later date. In the meantime, employers should not expect to receive any EEO-1 related communications until the EEOC’s funding is restored.
