The Democrat-controlled U.S. House of Representatives, on a partisan vote of 225 – 186 with only two Republicans voting yes, has approved a bill to end the use of pre-dispute arbitration agreements for employment and civil rights claims, among other types of claims. The so-called Forced Arbitration Injustice Repeal (FAIR) Act (H.R. 1423) was approved on September 20, but faces little prospect of being considered by the Republican-controlled U.S. Senate.

Nevertheless, the FAIR Act is one of the principal components of Congressional Democrats’ workplace reform agenda, and could move along with a host of other measures if the political dynamics shift after the next national election.
