According to data provided to us recently by the Administrative Office of the United States Courts, there were 1,316 lawsuits filed in federal court in Fiscal Year (FY) 2019 alleging violations of the Family and Medical Leave Act (FMLA). In contrast, the Labor Department’s Wage and Hour Division (WHD), which enforces the FMLA, reports that over the same period it resolved 1,040 administrative complaints filed with the agency under the law. This is the fourth year in a row in which lawsuits filed have exceeded administrative complaints resolved, and the gap between the two appears to be widening.
