As we have been reporting on a regular basis, regulatory reform has been a focus of President Trump and the Administration from Day 1. In the most recent development, the Administration has now turned its attention to particular challenges posed by agency investigation and enforcement that occurs before or instead of litigation in the judicial system.
The White House Office of Management and Budget (OMB) recently published a Request for Information (RFI), summarized below, asking for public comments on reforms to the agency adjudicatory process to “ensure adequate due process in regulatory enforcement and adjudication.” The RFI is similar to one issued by the Administration in 2017 to solicit ideas for reorganization of government. While the government reorganization plans have not borne much fruit, this effort is more targeted and could produce more concrete results.
