The Equal Employment Opportunity Commission (EEOC or Commission) has finalized revisions to its procedural regulations that will expressly permit an individual to file a charge of discrimination with the agency online. According to the EEOC, the revised rules do not create a new system for charge filing, but instead simply recognize the current process utilized by the agency and now update the agency’s regulations to account for the digital transmission of charge-related documents.
The amended rules also revise the language that the EEOC uses to notify charging parties that the agency’s investigation has found no reasonable cause that an unlawful employment practice has occurred. Finally, the revisions spell out more clearly the deadline for filing a charge with the EEOC where state or local law enforced by a Fair Employment Practices (FEP) agency does not cover the particular basis of discrimination alleged.
