In a development that is not unusual in conjunction with the close of its fiscal year, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has been settling pending enforcement actions at a rapid pace. Indeed, briefly summarized below are 16 financial settlements that have been announced by OFCCP since our last update in September.
Included in this latest round of settlements are six Early Resolution Conciliation Agreements (ERCAs), as well as one settlement of a formal administrative enforcement action resulting in a Consent Decree. Of the nine remaining settlements, eight resulted in a Conciliation Agreement (CA) stemming from a scheduled OFCCP compliance review, while one resulted in a CA from a complaint investigation. Keep in mind that OFCCP settlements are almost always reached, as was the case with every settlement discussed here, without any admission of guilt by the contractor.
