Consistent with our expectation that the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) would continue to aggressively seek to settle pending enforcement actions both in conjunction with the agency’s expiring fiscal year (October 1, 2019 – September 30, 2020), and perhaps in anticipation of a change in Administration this coming January, the agency has announced eight more financial settlements just since our last update in October.
This latest batch, posted in OFCCP’s Freedom of Information Act (FOIA) Library, includes both a Consent Decree and an Early Resolution Conciliation Agreement (ERCA) involving the same contractor, four other ERCAs, and three standard Conciliation Agreements (CAs). Notably, of these settlements, the majority were for alleged compensation discrimination and the others for alleged hiring discrimination.
