To no one’s surprise, the Biden Administration’s Department of Labor (DOL) has delayed the effective date of the previous administration’s new regulations governing classification of workers as independent contractors versus employees under the Fair Labor Standards Act (FLSA). The regulations, originally scheduled to go into effect on March 8, 2021, have now been delayed until May 7, 2021, and probably well beyond that.

Although DOL provided a brief pro forma opportunity for members of the public to submit comments on whether it should delay implementation of the regulations the outcome was a foregone conclusion.
