A few weeks ago, in an unprecedented, controversial, and legally questionable move, President Biden fired Peter Robb, the Republican General Counsel (GC) of the National Labor Relations Board (NLRB), even though Robb had 10 months remaining on his statutorily set term. And even while the controversy over Robb’s termination continues to simmer, the President has nominated union lawyer and former NLRB career official Jennifer Abruzzo, a Democrat, to take his place.

For the reasons discussed below, it could be weeks or even months before the U.S. Senate takes up Abruzzo’s nomination, which requires Senate confirmation. Regardless, however, the timing may not have any significant impact on delaying major changes in labor policy already being pursued by the General Counsel’s office and the Board’s Acting GC Peter Ohr.
