The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has filed its first formal administrative lawsuit since the Biden Administration assumed office. OFCCP’s formal complaint alleges unlawful discrimination in hiring by federal contractor ABM Janitorial Services (ABM). Among other things, OFCCP claims ABM’s conduct is “standard operating procedure” and a “regular” practice, and that the contractor has repeatedly failed to correct alleged hiring disparities at the three establishments under review.
Because formal administrative enforcement actions brought by OFCCP are relatively rare – OFCCP allegations of discrimination are almost always resolved through a settlement, most often in the form of a Conciliation Agreement (CA) – and because this is the first such action brought by the Biden Administration, we wanted to bring it to your attention.
