In a ruling that comes as no surprise, the U.S. Court of Appeals for the Second Circuit has tossed out an appeal of a federal trial court decision that blocked the Labor Department (DOL) from enforcing the industry-supported “joint employment” rule issued in 2020 by the Trump Administration under the Fair Labor Standards Act (FLSA). The appeals court concluded that there was nothing further to decide since the Biden Administration had rescinded the rule earlier this year while the appeal of the trial court’s ruling was still pending.
