The Equal Employment Opportunity Commission (EEOC) has posted an announcement on its website informing covered employers that the agency expects to open the filing period for the 2021 “Component 1” Employer Information (EEO-1) Reports on April 12, 2022, with an anticipated deadline just five weeks later, on May 17, 2022. Note, however, that the EEOC lists these dates as “tentative” and subject to change.

While the EEOC has released no further information regarding the upcoming 2021 EEO-1 filing season, at a minimum we do know that filers will be able to use an employee snapshot from the fourth quarter of 2021, and we expect that the current race, ethnicity, and sex categories used on the EEO-1 will remain the same. We also know that employers will not be required to file “Component 2” reports covering 2021, at least not at this time. Beyond that, there is little employers can do to prepare until the EEOC releases more information.
