The Department of Labor’s (DOL) Wage and Hour Division (WHD) and the National Labor Relations Board (NLRB) have made public a Memorandum of Understanding (MOU) signed late last year that is designed to formalize information sharing between these two worksite enforcement agencies.
Although there is nothing unusual about two agencies sharing information, this MOU is notable in that it sheds light on what is expected to be an area of increased enforcement emphasis between WHD and the NLRB, i.e., investigating “complex or fissured employment structures … designed to evade legal accountability.”
