Civil monetary penalties for violations of many of the federal laws and regulations enforced by the Equal Employment Opportunity Commission, the U.S. Department of Labor, and other executive branch agencies with worksite enforcement authority are going up again in 2022, as required by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015.
Pursuant to a memorandum issued in December 2021 by the White House Office of Management and Budget (OMB) to executive branch departments and agencies, they are instructed to increase the civil penalties for 2022 under the laws they enforce. And although 2022 updates were to be published by January 15, a number of agencies have not yet complied. Indeed, some agencies only recently published their 2021 updates. Importantly, these annual penalty increases do not take effect until they are published by the relevant agency.
