This past March, the Biden Administration announced that it had reached an agreement in principle with leaders of the European Union (EU) on a new “Trans-Atlantic Data Privacy Framework.” Implementation of the Framework is critical to facilitating the cross-border transfer of personal data, including employee data, in the wake of rulings by the European Court of Justice (ECJ) striking down prior U.S.-EU data privacy agreements as inadequate under EU data privacy regulations.
Following up on the agreement in principle reached earlier this year, President Biden has since taken steps to implement the new framework by signing an Executive Order (E.O.) enhancing safeguards for “signals intelligence activities” that, among other things, establishes a process for individuals to seek redress if they believe that their personal data was collected contrary to U.S. law. In a related development, the U.S. Department of Justice (DOJ) has implemented regulations establishing a Data Privacy Review Court to hear appeals of alleged privacy violations.
