Following a pattern established over several decades whenever there is a change in administration from one political party to the other, the National Labor Relations Board (NLRB or Board) is on the verge of transitioning from one political philosophy to another – in this case from a pro-employer policy (Trump) to a pro-employee bias (Biden). Indeed, now that a Biden-majority NLRB has been put in place, we expect it to pursue an unabashed pro-union agenda in the weeks and months ahead.

These developments are important not only to companies where employees are unionized, but also to the large number of companies that operate as non-union employers. Indeed, maintaining non-union status is going to become more challenging for many organizations if the new Biden-era NLRB proceeds as we expect it will, as discussed in more detail below.
