NT Lakis recently filed on behalf of the Center for Workplace Compliance (CWC) written comments with the Department of Labor (DOL) in response to its proposed rule that would codify into regulations the traditional and time-proven methodology for determining whether a worker is an employee or independent contractor.
Our comments strongly support the proposed rule, in particular noting how DOL’s multi-factor test for determining whether an individual is economically dependent on a potential employer is both consistent with doctrines used by the courts over many decades while also refined in such a way that it will be easier to understand and apply in practice.
