The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, has updated its resource entitled Outline of the Form I-9 Employment Eligibility Verification Process.

The Immigration Reform and Control Act requires employers to verify the identity and work authorization of all their new hires. Failure to verify new hires or knowingly hiring unauthorized workers subjects an employer to substantial fines. U.S. Citizenship and Immigration Services (USCIS) administers the Form I-9 process through which employers conduct this verification.

CWC’s Outline explains the types of documents that new hires may use and employers’ methods for examining them. It explains that an employer cannot require an employee to produce a particular document from the list of acceptable documents, nor can an employer require a document not listed on Form I-9.

In view of the Trump Administration’s focus on immigration issues, CWC aims to help employers comply with employee work authorization requirements. However, an employer should consult legal counsel if a problematic compliance situation arises at its organization.
