In a move that has created some confusion, the U.S. Department of Labor (DOL) has filed an appeal of the federal district court decision issued earlier this year that invalidated the Obama-Era DOL’s 2016 revisions of overtime regulations under the Fair Labor Standards Act (FLSA) applicable to certain white collar employees.  

Importantly, DOL’s appeal should not be read as a change of heart by the Trump DOL to now defend the controversial 2016 changes. Rather, it is designed as a strategic move to preserve the right of the agency and give it adequate time to issue a new final rule that will replace the Obama-Era rule.
