In Part I, to better assist employers in understanding the progression of a charge before submitting a position statement, we presented an overview of the current EEOC charge investigation process, including its ongoing digitization and the five common stages of a charge investigation.
In this Part II, we discuss the employer’s position statement in detail, focusing in particular on considerations for employers to keep in mind before drafting the statement; step-by-step suggestions for drafting the statement; and practical pointers to keep in mind when drafting the statement that have proven effective over time.
