In its latest status report to the federal court that earlier this year ordered the Equal Employment Opportunity Commission (EEOC) to collect “Component 2” pay and hours-worked data on a revised EEO-1 Report by the end of this month, the agency indicates that as of September 5, 2019, 13.4% of eligible filers have so far completed submission of Component 2 data.

According to the report, the EEOC will need to achieve a 72.7% filing rate in order to comply with the court’s order. To that end, the report indicates that the contractor (NORC) that the EEOC retained to conduct the Component 2 data collection has begun placing telephone calls to the approximately 37,000 employers required to file the Component 2 reports that have not yet contacted the NORC Component 2 help desk, registered for access to the online portal, or submitted data.

The EEOC also reports that it has begun the required process to seek Office of Management and Budget (OMB) approval of the EEO-1 Report and associated recordkeeping obligations for the next three reporting years (2019 through 2021). Importantly, the EEOC is only seeking approval for reporting of Component 1 data, data reported by job category, sex, and race/ethnicity. It is not seeking approval for reporting of Component 2 data.
