As of September 25, 2019, 39.7% of eligible filers had completed submission of their EEO-1 “Component 2” data reports, according to the latest status report submitted by the Equal Employment Opportunity Commission (EEOC) to the federal court that earlier this year ordered the agency to collect “Component 2” pay and hours-worked data for Calendar Years 2017 and 2018 by September 30, 2019.
Because the percentage of filers is well below the 72.7% of submissions that the EEOC says it needs to collect to fully comply with the court’s order, the agency is keeping the online filing portal open until that percentage is reached. Although the EEOC has not characterized this action as an extension of the filing deadline, that is the practical effect. No further information has been released as to how long the portal will be kept open, but employers should submit their Component 2 reports as soon as possible, if they have not done so already.
