During the Trump Administration, the Equal Employment Opportunity Commission (EEOC) adopted a policy limiting EEO-1 data sharing with state and local Fair Employment Practices Agencies (FEPAs). The policy restricted the EEOC from sharing with a FEPA data reported by an employer unless the employer was a respondent to a charge of discrimination as cited by the FEPA in its data request.

EEOC Chair Charlotte Burrows (D), who was designated as the new EEOC Chair by President Biden shortly after he assumed office, has now issued an Order rescinding this policy, essentially restoring the EEOC’s former practice of broadly sharing with FEPAs EEO-1 and similar demographic data reported by employers as long as appropriate data sharing agreements between the agencies existed, regardless of whether there were any charges pending against the employer.
