The Equal Employment Opportunity Commission (EEOC) has updated its COVID-19 guidance in the form of revisions to the Frequently Asked Questions (FAQs) posted on the agency’s website. The revised FAQs more clearly address the interaction of employer policies that either mandate or incentivize vaccination against COVID-19 and federal equal employment opportunity laws.
Most of the revisions are simply edits designed to improve the clarity and precision of previous guidance, although the revised FAQs also put more focus on Title VII’s pregnancy discrimination provisions, which require employers to ensure that pregnant workers are not denied accommodations that might be provided to other employees similar in their ability or inability to work.
