The Equal Employment Opportunity Commission (EEOC) hosted a public webinar recently entitled The EEO Implications of Using Artificial Intelligence and Machine Learning in Employment Decisions. Participants in the September 1 webinar included Commissioner Keith Sonderling, who essentially ran the webinar and framed the issue, as well as three EEOC Regional Directors and outside expert Cortnie Abercrombie, founder of AI Truth, a non-profit organization focusing on ethical issues related to the use of AI. None of the other EEOC Commissioners participated.

Although some 2,600 people registered for the webinar, contrary to standard practice regarding the agency’s public meetings, the EEOC leadership elected not to record the webinar nor make webinar materials available. Given the importance of the topic as an emerging employment law issue, we therefore thought it would be helpful to provide the following summary, focusing in particular on Commissioner Sonderling’s substantive presentation.
