Last week we reported that the Equal Employment Opportunity Commission (EEOC) had announced that the filing season for 2019 and 2020 EEO-1 Reports will begin sometime in late April of this year, but did not provide any more details. Since then, the agency has released two additional pieces of information that will now allow employers to get a head start and better prepare for the upcoming filing season.

Importantly, in its latest announcement, the EEOC has confirmed that the filing specifications for the 2019 and 2020 “Component 1” data files will be the same as the 2018 data collection specifications, permitting employers to begin formatting their data using their existing systems and procedures now if they so choose. Please note that unless the EEOC indicates otherwise, filers should anticipate doing a separate filing each for their 2019 and 2020 data.

In addition, the agency has announced that the popular “data file upload” filing method – the method used by the vast majority of employers to submit their EEO-1 Reports – is not likely to be available until “late May.”
