The Federal Acquisition Regulatory (FAR) Council, the entity that administers the government’s procurement requirements, has issued a memorandum to federal contracting agencies providing “initial direction” on incorporating a new contract clause to implement COVID-19 vaccine mandate guidance issued by the Safer Federal Workforce Task Force pursuant to President Biden’s Executive Order 14042.
As we recently reported, the Task Force Guidance calls for, among other things, all “covered [federal] contractor employees” to be fully vaccinated against COVID-19 by Wednesday, December 8, 2021, or by the first day of performance on the contract, whichever is later. The FAR Council memorandum specifies that the clause shall be inserted into covered new federal contracts awarded on or after November 14 and extensions, renewals, or options exercised on existing contracts and orders awarded on or after October 15, 2021.
