As we reported in August, the Federal Communications Commission (FCC) is considering reviving a long-dormant requirement mandating the reporting by broadcasters of demographic information similar to that required on the EEO-1 Report, but using outdated demographic categories.
In response to the agency’s request for public input on whether it should move forward, NT Lakis, on behalf of the Center for Workplace Compliance (CWC), has filed written comments asking the FCC to refrain from adopting a new and largely duplicative reporting requirement, instead urging the FCC to consider working cooperatively with the Equal Employment Opportunity Commission (EEOC) in its effort to assess industry trends.
Should the FCC nevertheless decide to move forward with its data collection mandate, we urge it to harmonize its reporting requirement with the EEO-1 Report to minimize the burden otherwise imposed on covered entities. To that end, our comments provide several examples of how using the FCC’s outdated form will lead to compliance challenges.
