Recently, many posting penalties have been increased as the result of a 2015 law that now requires federal agencies to review and make annual adjustments to posting penalties to keep up with inflation.
That law, the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, also requires inflationary adjustments in other types of fines, including those for violations of the 1986 Immigration Reform and Control Act (IRCA).
On June 30, 2016, the Department of Justice (DOJ) published an interim final rule that, among other things, increases the fines for a variety of IRCA violations, including I-9 recordkeeping violations, I-9-related document discrimination, and the unlawful employment of unauthorized aliens. The increases went into effect on August 1, 2016.
