Labor Department Is Now Publishing the Names and Locations of Third-Party Employers of H-1B Visa Holders

The U.S. Department of Labor (DOL) has begun publishing disclosure files from its Office of Foreign Labor Certification (OFLC) concerning several categories of foreign workers. OFLC, a unit of DOL’s Employment and Training Administration, processes labor certification applications for employers seeking to bring foreign workers into the U.S. The new disclosure policy is part of the Trump Administration’s ongoing effort to crack down on alleged employer abuse of so-called H-1B visas by, among other things, increasing transparency.

Last year, DOL issued a revised Labor Condition Application (LCA) form that required the employer to indicate if the H-1B worker will be placed at a third-party worksite, and if so, to provide the third party’s legal business name and address. Under the new disclosure policy, these third-party employers will be listed publicly even though they themselves did not file H-1B petitions.
