NT Lakis Lawyers have filed a formal written request with the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) asking the agency to extend the public comment period on its proposed rule to revise the procedures it uses to resolve “material violations” discovered during a compliance audit.
Joining several other employer groups that have filed separate requests asking for an extension of the comment deadline, the letter contends that the complicated (and novel) nature of OFCCP’s proposal merits additional time – beyond the short 30-day comment period that OFCCP has announced – to allow interested parties the opportunity to conduct a complete and accurate examination of the NPRM and provide their input.
OFCCP’s proposal would make significant revisions to the agency’s regulations implementing Executive Order 11246, Section 503 of the Rehabilitation Act (Section 503), and the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) in order to establish a framework for how discrimination allegations are identified, documented, and communicated to federal contractors, through the use of predetermination notices (PDNs) and notices of violation (NOVs).
