NT Lakis lawyers have filed a friend-of-the-court brief with the U.S. Court of Appeals for the Eighth Circuit in a case raising the issue of whether the Older Workers Benefit Protection Act (OWBPA) precludes enforcement of an arbitration agreement as to claims under the Age Discrimination in Employment Act (ADEA) involving releases.
Our brief in McLeod v. General Mills, Inc., joined by the Chamber of Commerce of the United States of America, urges the appeals court to overturn a troubling lower court ruling finding that OWBPA requires that ADEA claims involving releases can be resolved only by a court. We contend that the trial court’s ruling is wrong under federal arbitration law and a host of Supreme Court decisions.
