NT Lakis lawyers have submitted comprehensive written comments to the U.S. Department of Labor (DOL) in response to the agency’s proposal to revise its “regular rate” regulations under the Fair Labor Standards Act (FLSA). The proposed revisions to the regular rate regulations were published for public comment in the Federal Register on March 29, 2019.
Calculation of the so-called “regular rate” is critical for determining compliance with the FLSA’s overtime pay requirements. DOL’s current regular rate regulations, which have not been significantly revised since they were issued more than sixty years ago, do not provide helpful guidance about many types of pay and benefits currently provided to the modern workforce. DOL’s proposed revisions to the regulations are intended to close that gap.
