As we reported recently, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has now opened the online “Contractor Portal” to its new Affirmative Action Program Verification Interface (AAP-VI) initiative, a key step in the agency’s rollout of the AAP-VI. Under the AAP-VI, covered federal contractors and subcontractors will be required to certify to the agency, no later than June 30, 2022, that they have developed and maintained AAPs in accordance with OFCCP’s regulations.

Although covered contractors can now register with the Contractor Portal, there are many questions that still remain about the details of the AAP-VI certification process. OFCCP has stated that additional information will be forthcoming in advance of March 31, 2022, the date on which contractors can begin certifying their compliance. In the meantime, we have been in contact with OFCCP officials asking them to provide guidance on a number of practical compliance questions that have yet to be addressed.
