The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has issued a final rule revising the agency’s regulations interpreting the religious exemption contained within Executive Order (E.O.) 11246.
The final rule largely tracks the proposal published by OFCCP in August 2019 and amends the agency’s current regulations by: (1) adding four new definitions relating to the exercise and practice of religion; and (2) clarifying the scope and application of E.O. 11246’s religious exemption by articulating a new legal test and examples of what does and does not constitute a “religious corporation, association, educational institution, or society.”
