The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has made a formal request to the White House Office of Management and Budget (OMB) to approve proposed changes to the form (CC-4) OFCCP uses for accepting individual discrimination complaints under the laws that the agency enforces.

The proposed changes are designed primarily to update the CC-4 form to incorporate changes required by two Executive Orders (E.O.) issued by former President Obama.  These updates include listing “sexual orientation” and “gender identity” explicitly as protected characteristics, as mandated by President Obama’s 2014 Executive Order 13672 and OFCCP’s implementing regulations, and adding “inquiring about pay,” “discussing pay,” and “disclosing pay” as checkbox options for reporting alleged discrimination pursuant to E.O. 13665 and its implementing regulations.

As required by the federal Paperwork Reduction Act, OMB will be accepting public comments on the revised CC-4 for a 30-day period, or until March 23, 2017.
