The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has received final approval from the White House Office of Management and Budget (OMB) to begin implementing its Affirmative Action Program Verification Interface (AAP-VI). Once implemented, covered federal contractors will be required to: (1) certify annually that they have developed and maintained Affirmative Action Programs (AAPs) in accordance with OFCCP’s regulations; and (2) upload their AAPs and supporting materials to the agency if selected for a compliance evaluation.
While full implementation details have yet to be announced, documents provided by OFCCP to OMB in conjunction with its request for approval offer guidance on what contractors can expect, as discussed in more detail below. With regard to timing, OFCCP indicates that its online AAP-VI portal should be operational within the next 90 days, or by the end of November. The agency further indicates that contractors will then have an additional 90 days to come into compliance, which if things stay on schedule would be the end of February 2022.
