The White House Office of Management and Budget (OMB) has approved a new Scheduling Letter and Itemized Listing that the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) will use to schedule federal construction contractors for a compliance evaluation.
As approved by OMB, the new Scheduling Letter, which OFCCP can begin using immediately, will require federal construction contractors and subcontractors to provide the agency with their EEO and AAP supporting data in advance and off-site – instead of on-site – during the desk audit phase of a compliance evaluation, which conforms to the process that applies to a typical supply and service compliance evaluation. Despite our recommendations, under the revised Itemized Listing that accompanies the new Scheduling Letter, OFCCP will be requesting additional and more detailed data beyond those usually requested from supply and service contractors.
