President Trump has nominated Cheryl Stanton, who served in the White House Counsel’s office during the George W. Bush Administration, and who currently serves as Executive Director of the South Carolina Department of Employment and Workforce, to be the next Administrator of the Labor Department’s Wage and Hour Division (WHD). The Wage and Hour Division has enforcement authority over the Fair Labor Standards Act (FLSA) and the Family and Medical Leave Act (FMLA), among other federal employment laws.

Historically, the position of Wage and Hour Administrator, which requires confirmation by the U.S. Senate, has been difficult to fill. During both the George W. Bush and Obama Administrations, for example, WHD operated with an Acting Administrator for extended periods after the Presidents’ nominations stalled in the Senate.

A change in the Senate rules after the election of President Trump has made it easier to confirm the President’s nominations, however, and Ms. Stanton is ultimately likely to be confirmed, although there may still be considerable delays before a formal vote is taken.
