OFCCP has recently announced a number of new settlements, all in the form of Conciliation Agreements. These agreements are voluntary, negotiated settlements that are OFCCP’s preferred method of securing compliance. Note that the fact that a contractor decides to settle with OFCCP is not an admission of liability and does not necessarily mean that the agency’s allegations would have been upheld if the matter had been litigated.

Perhaps not surprisingly, these most recent settlements show that OFCCP continues to focus formal enforcement efforts on alleging discrimination committed by contractors that keep poor records of their hiring practices, especially in entry-level jobs.

Also worth noting, OFCCP recently launched on its website a new “Class Member Locator” tool that contains information on cases settled, including the redacted Conciliation Agreement (CA) and press release (if one was issued). All of the recently released conciliation agreements are currently listed on OFCCPs Class Member Locator.
