It has now been over five years since the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) issued its revised regulations implementing Section 503 of the Rehabilitation Act (Section 503) and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act (Section 4212).

OFCCP’s revised “503/4212” regulations represented a near-complete overhaul of federal contractors’ nondiscrimination and affirmative action requirements for individuals with disabilities and protected veterans, and put contractors on notice that compliance going forward would be more than simply a paperwork exercise as it had been in the past. 

Indeed, since 2014, OFCCP has increased its scrutiny into the sufficiency of contractors’ efforts to meet their Section 503/4212 obligations, and has now begun to schedule new Section 503 “focused review” compliance evaluations.
