Before leaving for its summer recess last week, the U.S. Senate confirmed two nominees for critical positions at the Equal Employment Opportunity Commission (EEOC). Sharon Gustafson, a solo practitioner who was nominated by President Trump to be the agency’s new General Counsel way back in March 2018, and Charlotte Burrows, an EEOC Commissioner originally appointed by President Obama and renominated recently by President Trump for a second term, were both confirmed by unanimous consent.
Ms. Burrows’ confirmation means that the EEOC will be able to operate with a quorum composed of a 2 – 1 Republican majority until at least the middle of next year, barring an unexpected resignation. The Commission still has one Democratic and one Republican vacancy.
