The U.S. Court of Appeals for the Seventh Circuit ruled recently in the case of Ford v. Marion County Sheriff’s Office that claims of workplace harassment based on an individual’s disability are actionable under the federal Americans with Disabilities Act (ADA). The Seventh Circuit thus joins at least eight other federal appeals courts that have either explicitly held or have assumed without deciding that workplace harassment claims are viable under the ADA. NT Lakis is not aware of any courts that have ruled to the contrary.
