The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, testified at an Equal Employment Opportunity Commission hearing on the agency’s proposal to rescind EEO reporting requirements, including the EEO-1 Report. CWC’s testimony focused on preserving employers’ ability to use demographic information as a compliance tool.
In his testimony, CWC’s Mike Eastman focused on the practical compliance value of aggregate workforce analytics. Eastman urged the EEOC to distinguish between decisionmaking based on demographic characteristics and the use of demographic data to evaluate compliance with nondiscrimination laws. He explained that aggregate demographic analyses can help employers identify potential compliance concerns, assess the operation of workplace policies, and address legal risks. Eastman urged the EEOC to clarify that rescinding EEO-1 reporting would not prohibit the lawful collection and analysis of demographic data about race, sex, ethnicity, or other protected characteristics for compliance purposes.
