An executive order from the Mayor of Chicago could make some discrimination and wage theft violations a barrier to contracting with the city.

On August 26, Chicago Mayor Brandon Johnson signed Executive Order 2026-6, directing the city to establish requirements for contractor disclosure, certification, and employee-notice tied to workplace antidiscrimination and wage theft compliance. Current and prospective contractors and subcontractors must certify that they have not committed such violations during the preceding five years and will not do so during the contract term. Many disclosures will be made public. The EO also directs the city to adopt rules prohibiting contracts and subcontracts with entities that have committed covered violations within the previous five years.

The order leaves several questions unanswered, including the definition of a disqualifying violation and the weight of administrative agency findings and other matters that have not been fully adjudicated.
