The Federal Communications Commission has formally eliminated Form 395-B, the broadcaster workforce demographic report. The FCC described the action as a conforming amendment to remove an obsolete rule from its regulations.
The form had been suspended since 2001, after a federal appeals court concluded that the agency lacked authority to require the filing. The agency attempted to reinstate Form 395-B in 2024, but pending litigation prevented the reporting requirement from taking effect.
This action has little immediate impact because broadcasters have not had to file Form 395-B since 2001. Nevertheless, it is the latest sign of a wider reassessment of the federal government’s role in collecting workforce demographic information.
