The Equal Employment Opportunity Commission (EEOC) has published a new “resource document” that walks through many aspects of a request for leave as a possible reasonable accommodation under the Americans with Disabilities Act (ADA), and raises issues that an employer may wish to consider when responding to such a request. As a threshold matter, the new guidance sticks to well-established EEOC policy positions and does not purport to create any new law.
