The White House Office of Management and Budget (OMB) on May 24 gave final approval to revisions of the form used by the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) for accepting individual discrimination complaints under the laws enforced by the agency.

The proposed changes are designed primarily to update the CC-4 to incorporate changes required by two executive orders (E.O.) issued by former President Obama.

More specifically, Form CC-4 now explicitly lists “sexual orientation” and “gender identity” as protected characteristics, as mandated by President Obama’s 2014 Executive Order 13672 and OFCCP’s implementing regulations. In addition, “inquiring about pay,” “discussing pay,” and “disclosing pay” have been added as checkbox options for reporting alleged discrimination pursuant to E.O. 13665 and its implementing regulations, which prohibit federal contractors from discriminating against employees on these grounds.
