President Trump has nominated attorneys Marvin Kaplan and William J. Emanuel to fill the two open seats on the five-member National Labor Relations Board (NLRB). If confirmed by the Senate, Mr. Kaplan and Mr. Emanuel, both Republicans, would give the party a majority on the NLRB for the first time since December 2007.
Over the last several years, the Democratic-controlled NLRB during the Obama Administration extended the reach of the National Labor Relations Act (NLRA) well beyond its traditional limits by challenging employer workplace policies having little to do with labor relations. Under a new Republican majority, the NLRB is expected to roll back, over time, many of these controversial decisions and refocus its attention on dealing with traditional union-management issues.
