The Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) published a notice recently announcing that it intends to seek approval from the White House Office of Management and Budget (OMB) to extend the agency’s regulations pertaining to construction contractors, including new requirements imposed on construction contractors by the agency’s recent regulations dealing with pay transparency and sexual orientation and gender identity. The current OMB authorization for the construction contractor paperwork requirements expires on February 28, 2018.

Periodic requests by federal agencies to extend information collection requirements (ICR) are required under the federal Paperwork Reduction Act (PRA), and must be formally approved by OMB. The process is initiated, as here, with a published “pre-clearance consultation” in which interested parties have the opportunity to comment on the content of the collection, and the burdens and utility of the particular recordkeeping and reporting requirements at issue before the agency submits its formal request for extension to OMB.
